ispONE files urgent Federal Court application

Courth hearing today to request stopping prepaid service terminations

Telstra wholesaler, ispONE, has filed an urgent application with the Federal Court seeking to restrain Telstra from terminating the supply of prepaid mobile services to ispONE.

A hearing is expected today by a Federal Court judge.

The wholesaler on-supplies Telstra prepaid services through more than 100 retailers to over 280,000 consumers of fixed line, mobile phone, and Internet services.

According to a statement from ispONE, Telstra claims it has a right to terminate the services due to the failure by ispONE to pay invoices issues by the telco by their due date.

ispONE on the other hand claims that no amount is presently due and payable, and alleges Telstra owes it money based on the telco’s incorrect rating of data pricing for prepaid mobile services.

In addition, the wholsesaler asserts that Telstra has allegedly breached its agreement with ispONE, and allegedly engaged in misleading, deceptive and unconscionable conduct.

It also claims an entitlement to damages based on the significant problems experienced with Telstra’s mobile prepaid platform, which, according to ispONE, earlier this year left many consumers without service as there were delays in porting numbers to Telstra.

The statement also states ispONE has been “acting swiftly to attempt to affect a resolution of its issue with Telstra” in order to mitigate any termination, and has issued the Court application as these attempts have been unsuccessful.

A Telstra spokesperson could not immediately be reached for comment.
